Definitions:

The terms used in these General Terms and Conditions of Sale (GTC) with a capital letter, without prior definition, have the meanings given below:

Client : Refers to an adult individual acting for personal purposes and with full legal capacity to commit under these terms.
Conditions of Sale for the Reserved Rate : Refers to the specific conditions for each booking made by the Client.
Booking Confirmation : Refers to the document summarizing the details of the booking made by the Client, sent by the website or the Riad to the Client.
Booking Request : Refers to any room booking request made by the Client.
Riad : Refers to the Riad Kahena Lifestyle Concept, located at 34, Derb Sarij Medina, Marrakech, Morocco.
Partners : Refers to all service providers who have signed a service contract or partnership agreement with the Riad.
Service : Refers to any room booking service or additional service offered by the Riad.
Riad Website : Refers to the website dedicated to the Riad, accessible at www.riad-kahena.com.

ARTICLE 1 – Cancellation Fees for Individual Clients

In the event of a booking cancellation by the Client, the following fees will apply:

More than 14 days before arrival : 30% of the total booking amount will be charged.
Less than 14 days before arrival, no-show, or early departure : 100% of the total booking amount will be due to Riad Kahena.

Indicative exchange rate: 1 € = 11 MAD

ARTICLE 2 – Scope of Application

These GTC apply, without restriction or reservation, to any purchase of room booking services and additional services ("Services") offered by Riad Kahena Lifestyle Concept ("the Provider" or "the Riad") to consumers and non-professional clients ("Clients" or "Client") on the Riad's website.

The main features of the Services are presented on the Riad's website. The Client must review them before making any booking. The choice and purchase of a Service are the sole responsibility of the Client.

The Client declares:

To have full legal capacity to commit under these GTC.
To make the booking for personal purposes.
To be able to save and print these GTC.

These terms apply to the exclusion of all other terms, including those applicable to other channels for marketing the Services.

The GTC are accessible at any time on the Riad's website and will prevail, if applicable, over any other version or contradictory document.

Unless proven otherwise, the data recorded in the Provider's computer system constitutes proof of all transactions concluded with the Client.

The Riad ensures the preservation of the written contract under electronic or paper format for a maximum duration of 5 years.

The Client acknowledges having the required capacity to contract and acquire the Services offered on the Riad's website.

ARTICLE 3 – Bookings

The Client selects the services they wish to book on the website according to the following steps:

Selection of the type of room and rate.
Selection of additional services, if applicable.
Verification and validation of the booking details, total amount, and rate conditions.
Entry of their personal information.
Entry of their bank card details for guarantee or prepayment purposes.
Review and acceptance of the GTC and the selected rate conditions before confirming the booking.
Validation of the booking.

The Client is solely responsible for their choice of services and their suitability for their needs.

ARTICLE 4 – Rates

The Services offered by the Riad are provided at the rates in effect on the website at the time of booking. Prices are expressed in Moroccan Dirhams (MAD), inclusive of all taxes (TTC), unless stated otherwise.

The rates take into account any discounts granted by the Riad and are fixed during their validity period.

The rates do not include the tourist tax, which is payable directly on-site.

ARTICLE 5 – Payment Terms

Payment for Services can be made by credit card (Visa, MasterCard, etc.) via a secure system.

Payments made by the Client will only be considered final after the effective collection of the amounts due.

ARTICLE 6 – Provision of Services

The Services reserved by the Client will be provided as specified in these GTC.

The Client must comply with the rules of conduct and use of the Riad's facilities. In the event of behavior contrary to public order or moral standards, the Riad reserves the right to ask the Client to leave the premises without compensation or refund.

ARTICLE 7 – Personal Data Protection

In accordance with Moroccan law no. 09-08 on the protection of personal data, the personal data requested from the Client is necessary for processing their booking and issuing invoices.

This data is processed by the Riad and may be shared with its partners as part of the execution of the Services.

The Client has the right to access, correct, and oppose the processing of their personal data. This right can be exercised by contacting the Riad at the following address:

ARTICLE 8 – Intellectual Property

The content of the Riad's website is protected by Moroccan intellectual property laws. Any total or partial reproduction is strictly prohibited.

ARTICLE 9 – Disputes

These GTC are governed by Moroccan law. In case of a dispute, the parties will strive to find an amicable solution. Failing that, the competent courts of Marrakech will have jurisdiction.

ARTICLE 10 – Acceptance of the GTC

Booking on the Riad's website implies full and unconditional acceptance of these GTC.
